Terms and conditions
Last updated: 14 August 2026These terms cover the ElasticRecruiter website, your client account and every candidate profile we deliver. Please read them before you unlock anyone.
Who we are
ElasticRecruiter is a service operated by ElasticDash Inc.. In these terms, "we" and "us" mean ElasticDash Inc., and "you" means the company using the service.
By using the service or unlocking a profile you accept these terms. If you are accepting on behalf of a company, you confirm that you are authorised to bind it.
Definitions
A candidate is a person we source, screen or test for one of your roles. A profile is the record we build for that candidate, including screen notes and technical test results.
To unlock a profile is to pay the fee that reveals the candidate's name and contact details. The fee is the flat $299 charged per profile unlocked.
A role is a position you ask us to fill, usually described by a job description you send us.
What we do
You send a job description. We read it against your product and your stack, post the role to the boards that matter for it, source candidates beyond those boards, screen applicants against your criteria, confirm interest by phone and email, and set a technical test generated from the role.
You can review everything about a candidate except their identity before you pay: stack, seniority, screen notes, test submission and score. Nothing obliges you to unlock anyone.
We are a recruitment service. We do not employ candidates, we do not supply them as contractors, and we are not a party to whatever you agree with them.
Your account
Parts of the service need an account. Keep your details accurate and your credentials to yourself. You are responsible for what happens under your account, including unlocks made by people you give access to.
Tell us promptly if you believe someone else has your credentials.
Unlocking a profile
Unlocking reveals a candidate's name and contact details. It is per profile and per role: unlocking a candidate for one role does not unlock them for another.
An unlock is always your decision. We never unlock a profile on your behalf, and we do not charge for profiles you only look at.
Fees
The fee is $299 per profile unlocked. It is flat. It does not change with the candidate's salary, seniority or location.
Nothing is charged on hire. There is no commission, no percentage of first-year salary, no retainer and no minimum spend. If you unlock nobody, you pay nothing.
Fees are incurred at the moment you unlock. We invoice monthly for that month, and invoices are payable within 14 days.
Job board costs
Some job boards charge to post. Where one does, we bill that cost to you at cost, and we tell you what it is before we post. You are never charged a posting fee you have not agreed to.
There are no other charges.
Taxes
Fees are exclusive of VAT, sales tax and any similar tax. Where we are required to charge one, it is added to your invoice.
Refunds
The unlock fee is not refundable, because what it buys is delivered the moment it is paid.
There is one exception. If the contact details we reveal are wrong, or the candidate cannot be reached through them, tell us within 14 days and we will refund that unlock or replace it with another profile, whichever you prefer.
A candidate who turns down your offer, does not pass your own interview, or leaves after being hired is not a refundable event. The fee buys a vetted, interested and reachable person, not an outcome.
What we do not promise
We do not guarantee that you will hire anyone, that a candidate will accept an offer, that they will stay, or that they will perform.
Screening and technical testing reduce risk. They do not remove it. Every hiring decision, and every consequence of one, is yours.
Test results and screen notes are our assessment on the day they were made. They are evidence, not a certification.
Your obligations
Give us a role description that is accurate and criteria that are lawful. We will not screen against criteria that discriminate on a protected characteristic, and we will tell you if what you have asked for does.
Hiring decisions are yours, and so are the checks that go with them: right to work, references, background checks where you need them, and any regulated requirement that applies to the role.
Use profiles only to evaluate candidates for your own roles.
Candidate data and confidentiality
Profiles are confidential. Use them inside your company, for the role you unlocked them for. Do not publish them, sell them, or pass them to anyone else, including a group company or an agency working for you, without our written agreement.
Candidates give us their information on the understanding that it reaches companies that are genuinely hiring. Handle it accordingly, and in line with the data protection law that applies to you.
We keep candidate and client data for as long as we need it to run the service and to meet our legal obligations, and no longer.
Going around the unlock
The fee is what pays for the work behind a profile. So if we surface a candidate to you and you engage them within 12 months of us first showing you their profile, the fee is payable whether or not you unlocked them.
That covers hiring them directly, through another agency, as a contractor, or through a company they control, and it applies to any role at your company rather than only the one we surfaced them for.
This is not a penalty and it is not a commission. It is the same $299, once.
Intellectual property
The website, the technical tests we generate, the scoring and the reports are ours. Unlocking a profile gives you the right to use that profile inside your company to evaluate and contact the candidate, and nothing beyond that.
Do not republish our test tasks, and do not use them to build your own assessment.
Acceptable use
Do not scrape the site, access it with automated tools, attempt to reveal identities without unlocking them, or reverse engineer any part of the service.
Do not use the service to advertise a role that does not exist, or to collect candidate data you have no intention of hiring for.
Third party services
We post roles to job boards and use third party tools to run parts of the service. Those services have their own terms, and we are not responsible for how they behave or for what they show.
Disclaimers
The service is provided as it is. To the extent the law allows, we exclude implied warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement.
We do not warrant that the site will be uninterrupted or free of errors.
Limitation of liability
To the extent the law allows, neither of us is liable to the other for indirect or consequential loss, or for lost profits, lost revenue, lost data or lost business opportunity, however it arises.
Our total liability arising out of these terms is limited to the fees you paid us in the 12 months before the claim.
Nothing here limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence.
Indemnity
You will indemnify us against claims arising from your use of the service in breach of these terms, from your hiring decisions, and from how you handle candidate data after we deliver it.
Termination
There is no contract term and no notice period. You can stop using the service whenever you like, and we can stop providing it to you, with notice.
Termination does not cancel fees already incurred. The clauses meant to outlast it do: confidentiality, going around the unlock, intellectual property, liability and governing law.
Changes to these terms
We update these terms as the service changes, and the date at the top says when we last did.
If a change materially affects you, we will tell you before it takes effect. Continuing to use the service after that means you accept the new terms. Fees already agreed do not change retroactively.
Governing law and disputes
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules, and the courts of Delaware have exclusive jurisdiction.
Before either of us starts proceedings, we will each try in good faith to resolve the matter by talking, for 30 days.
